Madame:

 

     Your Committee on Health, to which was referred H.B. No. 872 entitled:

 

"A BILL FOR AN ACT RELATING TO HEALTH,"

 

begs leave to report as follows:

 

     The purpose of this measure is to authorize health care practitioners to make undesignated prescriptions for epinephrine for the purpose of stocking a supply at various types of business and state and county government offices, including public schools.

 

     Your Committee received comments on this measure from the Department of Education and Department of Health.

 

     Your Committee finds that anaphylaxis is a life-threatening allergic reaction that is characterized by rapid onset and the involvement of multiple organ systems.  Individuals who are unaware of an allergy or who have had only mild allergic reactions in the past may suddenly experience a life-threatening reaction.  Your Committee further finds that the first-line treatment for anaphylaxis is the timely administration of epinephrine, which reduces the risk of fatal or debilitating outcomes associated with anaphylaxis.  This measure is intended to improve survival rates and health outcomes for persons affected by severe allergies by allowing various entities to stock a supply of undesignated epinephrine.

     Your Committee notes the concerns of the Department of Health in their written testimony regarding the potential costs and administrative responsibilities associated with this measure.  Your Committee appreciates these concerns but notes that this measure is discretionary and not a requirement on the Department of Health or practitioners.

 

     Your Committee has amended this measure by:

 

     (1)  Replacing all references of "auto-injectable epinephrine" with "single-use epinephrine";

 

     (2)  Clarifying that instruction in the administration of single-use epinephrine given to state and county employees and agents shall be by a practitioner or registered nurse;

 

     (3)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Health that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 872, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 872, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
