     Your Committee on Judiciary, to which was referred H.B. No. 871, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE HAWAIIAN HOMES COMMISSION ACT,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to clarify that Act 130, Session Laws of Hawaii 2024, which amended the Hawaiian Homes Commission Act, takes effect on the earlier of the date of the Secretary of the Interior's notification letter that Act 130 does not require congressional approval, or on the date that the United States Congress approval becomes law.

 

     Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands.

 

     Your Committee finds that the Legislature enacted Act 130, Session Laws of Hawaii 2024 (Act 130), to increase the loan limit for direct loans provided by the Department of Hawaiian Home Lands to seventy-five percent of the maximum single residence loan amount allowed in the State by the United States Department of Housing and Urban Development's Federal Housing Administration, instead of fifty percent.  However, Act 130 did not accurately note the necessary approval process for proper amendment of the Hawaiian Homes Commission Act of 1920.  This measure will correct this error and ensure that Act 130 accurately reflects the necessary approval process for the enactment of laws that amend the Hawaiian Homes Commission Act of 1920.

 

     Your Committee has amended this measure by making it effective upon its approval.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 871, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 871, H.D. 1, S.D. 1.
