Madame:
Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 818, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO THE WAIAKEA COMMUNITY DEVELOPMENT DISTRICT,"
begs leave to report as follows:
The
purpose of this measure is to revitalize
Waiakea Peninsula by:
(1) Establishing the Waiakea Peninsula Community
Development District within the Hawaii Community Development Authority;
(2) Specifying the powers and duties of the Hawaii
Community Development Authority as it relates to the new development district;
and
(3) Establishing the Waiakea Community Development
District Special Fund.
Your Committee received testimony in support of this measure from the Hawaii Community Development Authority; two members of the Hawaiʻi County Council; and two individuals. Your Committee received comments on this measure from the Department of Budget and Finance; Department of the Attorney General; and Department of Land and Natural Resources.
Your Committee finds that this measure would help revitalize the Waiakea peninsula, which forms part of the premier tourism district of the east side of Hawaii Island. Many of the properties in the Waiakea peninsula are in disrepair or obsolete. Your Committee further finds that the establishment of a community development district in the Hilo area will permit the Hawaii Community Development Authority to conduct long-range planning for the district and facilitate development through community input and adoption of proper zoning rules.
Your Committee has amended this measure by:
(1) Specifying that revenues, income, and receipts derived from leases are paid to the agency that owns or manages the property;
(2) Including the Chairperson of the Board of Land and Natural Resources for purposes of the determining quorum and majority for matters affecting the Waiakea Peninsula Community Development District by the Hawaii Community Development Authority; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 818, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Finance in the form attached hereto as H.B. No. 818, H.D. 2.
