Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 800, H.D. 1, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO GOVERNMENT,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to transfer ownership of certain properties between the State and the City and County of Honolulu.

 

     More specifically, this measure:

 

     (1)  Provides for the transfer of certain parcels in the Liliha Civic Center area and Iwilei Fire Station area from various state agencies to the City and County of Honolulu;

 

     (2)  Provides for the transfer of the parcel of land upon which Alii Tower is sited from the City and County of Honolulu to the Department of Land and Natural Resources; and

 

     (3)  Exempts the lands transferred to the Department of Land and Natural Resources under this Act from the definition of public lands for the purposes of Chapter 171, Hawaii Revised Statutes.

 

     Your Committee on Conference finds that this measure will significantly contribute to addressing the State's urgent office space requirements by providing an opportunity to secure long-term office space for State agencies, consequently diminishing government dependence on privately-owned commercial office space.  Your Committee on Conference further finds that exchanging the specified state properties for the fee simple interest in the parcel of land designated as Alii Tower will yield mutual benefits and substantial longterm advantages for both the State and the City and County of Honolulu.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Clarifying that the transfer of lands in parts I and II of the measure shall be effective December 31, 2025, or upon final approval by the City and County of Honolulu of the terms of the transfer of the Alii Tower parcel to the Department of Land and Natural Resources, whichever occurs later;

 

     (2)  Requiring the Governor to notify the Legislature and the Revisor of Statutes upon the completed transfer of the fee simple interest in land pursuant to part II of the measure; and

 

     (3)  Providing that if the City and County of Honolulu does not finalize approval of the terms of the transfer required under part II of the measure by December 31, 2026, the measure shall be repealed on January 1, 2027.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 800, H.D. 1, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 800, H.D. 1, S.D. 2, C.D. 1.
