Madame:

 

     Your Committee on Water & Land, to which was referred H.B. No. 510 entitled:

 

"A BILL FOR AN ACT RELATING TO DECLARATION OF WATER SHORTAGE AND EMERGENCY,"

 

begs leave to report as follows:

 

     The purpose of this measure is to amend the conditions, manner, and areas in which the Commission on Water Resource Management can declare and provide notice of water shortages and emergencies.

 

     Your Committee received testimony in support of this measure from the Department of Land and Natural Resources and Honolulu Board of Water Supply.  Your Committee received testimony in opposition to this measure from Hawaiʻi Farm Bureau.

 

     Your Committee finds that the Commission on Water Resource Management (Commission) is tasked with formulating water shortage plans and adopting a reasonable system of permits to properly plan for future water shortages.  Your Committee further finds that existing law does not allow the Commission to declare a water shortage in non-designated water management areas.  As water shortages affect all users in a region, your Committee believes that it is vital to allow the Commission to respond to conditions anywhere in the State that threaten the State's water supply when issuing water shortage and emergency declarations.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 510, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 510, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
