Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 277, H.D. 2, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO VEHICULAR PURSUIT,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to, beginning July 1, 2027, establish a vehicular pursuit policy for law enforcement agencies.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Changing the implementation date of the vehicular pursuit policy, including all related requirements, to January 1, 2027;

 

     (2)  Specifying qualified offenses that authorize law enforcement officers to engage in a vehicular pursuit;

 

     (3)  Requiring the Department of the Attorney General to adopt rules regarding the collection and reporting of certain information and Law Enforcement Standards Board to develop a model vehicular pursuit policy by July 1, 2026;

 

     (4)  Requiring each law enforcement agency to adopt a written policy regarding vehicular pursuit and make publicly available certain information related to vehicular pursuit by January 1, 2027;

 

     (5)  Specifying circumstances when limited portions of a law enforcement agency's vehicular pursuit policy may be redacted;

 

     (6)  Deleting the deadlines for the following:

 

          (A)  The development of minimum requirements for introductory and in-service training for law enforcement officers by the Law Enforcement Standards Board;

 

          (B)  When each law enforcement agency, as part of its pursuit policies, are required to make clear to their employees that any violation of the vehicular pursuit policies will result in discipline; and

 

          (C)  When the Attorney General is authorized to investigate, and if warranted, bring a civil action against any law enforcement agency;

 

     (7)  Changing the effective date to upon approval; and

 

     (8)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 277, H.D. 2, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 277, H.D. 2, S.D. 2, C.D. 1.
