Sir:
Your Committee on Judiciary, to which was referred H.B. No. 226, H.D. 3, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO WINDSHIELD TINTING,"
begs leave to report as follows:
The purpose and intent of this measure is to:
(1) Prohibit a person from installing, mounting, adhering, affixing, or using any sun screening device in conjunction with the glazing material of a motor vehicle with mirrored, metallic red, yellow, amber, or blue tint;
(2) Require all drivers and passengers of motor vehicles with applied tint to fully roll down their windows when stopped by a law enforcement officer at a traffic stop;
(3) Exempt side windows to the rear of the driver and rear windows on sedans from sun screening device requirements; and
(4) Increase the minimum and maximum fines for violating sun screening device requirements.
Your Committee received testimony in support of this measure from the Department of Transportation; Ohana Unity Party; Kaloko Tinting LLC; T&T Tinting Specialists, Inc.; and one individual.
Your Committee finds that human-driven climate change has resulted in increased temperatures globally. Your Committee further finds that darker tints on car windows have a measurable impact on reducing heat trapped in a car's interior. However, your Committee believes that the light transmittance limit of thirty-five percent for glazing on car windows allowed by existing law is inadequate to address the increased temperatures caused by climate change. This measure will update existing sun screening device requirements to ensure residents of the State may take appropriate steps to mitigate the harmful effects of climate change.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 226, H.D. 3, S.D. 1, and recommends that it pass Third Reading.
