Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 226, H.D. 3, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO WINDSHIELD TINTING,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to:

 

     (1)  Prohibit a person from installing, mounting, adhering, affixing, or using any sun screening device in conjunction with the glazing material of a motor vehicle with mirrored, metallic, red, yellow, amber, or blue tint;

 

     (2)  Require all drivers and passengers of motor vehicles with applied tint to fully roll down their windows when stopped by a law enforcement officer at a traffic stop;

 

     (3)  Exempt side windows to the rear of the driver and rear windows on sedans from sun screening device requirements; and

 

     (4)  Increase the minimum and maximum fines for violating sun screening device requirements.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Replacing metallic finishes with high reflective finishes that produce a red, yellow, amber, or blue appearance;

 

     (2)  Including certain exceptions to the requirement that all drivers and passengers of motor vehicles with applied tint to fully roll down their windows when stopped by a law enforcement officer;

 

     (3)  Clarifying the light transmittance levels on sun screening devices used in conjunction with glazing material for front side windows and wing windows;

 

     (4)  Exempting rear windshields on certain vehicles from sun screening device requirements;

 

     (5)  Making the absence of the certificate certifying that a sunscreen device complies with the law in a vehicle, prima facie evidence that an installer is noncompliant with the law;

 

     (6)  Requiring the Department of Transportation to notify all licensed motor vehicle inspection stations of the changes to sun screening device requirements by this measure within 90 days after the enactment of this measure;

 

     (7)  Inserting a savings clause;

 

     (8)  Making it effective upon approval; and

 

     (9)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 226, H.D. 3, S.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 226, H.D. 3, S.D. 1, C.D. 1.
