     Your Committee on Finance, to which was referred H.B. No. 139, H.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO INSURANCE,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require insurers, mutual benefit societies, and health maintenance organizations to provide coverage for standard fertility preservation services for persons undergoing medically necessary treatment that may cause iatrogenic infertility, for policies, contracts, plans, and agreements issued or renewed after December 31, 2025.

 

     Your Committee received testimony in support of this measure from the Hawaii Society of Clinical Oncology; Association for Clinical Oncology; FORCE:  Facing Our Risk of Cancer Empowered; Leukemia & Lymphoma Society; Advanced Reproductive Medicine & Gynecology of Hawaii, Inc.; Fertility Institute of Hawaii; Hawaii Association of Health Plans; American Cancer Society Cancer Action Network; Oncology Nursing Society; Alliance for Fertility Preservation; Hawaii Medical Service Association; and five individuals.  Your Committee received comments on this measure from the Department of Commerce and Consumer Affairs; Department of the Attorney General; and Office of the Auditor.

 

     Your Committee notes the concerns of the Department of the Attorney General in its written testimony regarding the following potential issues: possible delegation of legislative authority;

impairment of existing contracts; and whether the State is required to defray the cost of mandated coverage.  Your Committee respectfully requests your Committees on Health and Consumer Protection & Commerce to address these concerns, should the measure progress through the legislative process.

 

     As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 139, H.D. 2, and recommends that it pass Third Reading.
