Madame:

Your Committee on Finance, to which was referred H.B. No. 1378, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO THE STATE FOUNDATION ON CULTURE AND THE ARTS,"

begs leave to report as follows:

The purpose of this measure is to:

(1) Establish the Performing Arts Grant Program and Performing Arts Grants Special Fund to support performing arts in the State;

(2) Clarify the scope of the State Foundation on Culture and the Arts' responsibilities to include the coordination, planning, promotion, marketing, and execution of performing arts events; and

(3) Appropriate funds to provide grants under the Performing Arts Grants Program.

Your Committee received testimony in support of this measure from one individual.

Prior to the hearing on this measure, your Committee posted and made available for public review a proposed H.D. 2, which preserves the contents of this measure and additionally:

(1) Amends the funding sources for the State Art Museum;

(2) Amends the amounts required to be transferred by agencies into the Works of Art Special Fund and the allowable uses of monies from the Works of Art Special Fund; and

(3) Appropriates federal funds and general funds for the operations of the State Foundation on Culture and the Arts.

Your Committee received comments on the proposed H.D. 2 from the Department of Budget and Finance and Hawai‘i State Foundation on Culture and the Arts.

Your Committee has amended this measure by adopting the proposed H.D. 2 and further amending the measure by:

(1) Changing to unspecified amounts the:

(A) Cap on the total amount of the one percent of appropriations to be transferred to the Works of Art Special Fund per fiscal year; and

(B) Maximum unencumbered balance of the Works of Art Special Fund for the previous fiscal year to prevent additional amounts of the one percent of appropriations from being transferred; and

(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1378, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 1378, H.D. 2.
