Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1365, H.D. 2, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO THE DEPARTMENT OF AGRICULTURE,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to:

 

     (1)  Appropriate funds to the Department of Agriculture for a Non-Potable Water Wells Pilot Program to prepare an environmental impact statement or environmental assessment to drill non-potable water wells on individual parcels at Panaewa Agricultural Park and Panaewa farm lots;

 

     (2)  Require the Department of Agriculture to consult and coordinate with the Department of Hawaiian Home Lands on the location and distribution of water from non-potable water wells before and after the completion of the environmental impact statement or environmental assessment; and

 

     (3)  Require any non-potable water well or improvement on individual parcels at Panaewa Agricultural Park and Panaewa farm lots that is completed according to the environmental impact statement or environmental assessment to revert to the State upon the lease expiration date.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Removing the requirement that the Department of Agriculture consult and coordinate with the Department of Hawaiian Home Lands on the location and distribution of water from non-potable water wells;

 

     (2)  Clarifying that the non-potable water wells or improvements that shall revert to the State are those on individual parcels under the Department of Agriculture;

 

     (3)  Inserting an appropriation amount of $300,000 for the Non-Potable Water Wells Pilot Program;

 

     (4)  Changing the effective date to July 1, 2025; and

 

     (5)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 1365, H.D. 2, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 1365, H.D. 2, S.D. 2, C.D. 1.
