Madame:
Your Committee on Transportation, to which was referred H.B. No. 1301 entitled:
"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"
begs leave to report as follows:
The
purpose of this measure is to:
(1) Repeal the Public Utilities Commission's authority to regulate ratemaking for motor carriers;
(2) Apply the existing framework regulating motor carriers onto transportation network companies; and
(3) Repeal the chapter regulating transportation network companies.
Your Committee finds that Hawaii is the only state in the United States regulating motor carriers. In 1995, the Interstate Commerce Commission Termination Act of 1995 extended Hawaii's exemption from the preemption of states' rights to govern the transportation of freight, preserving Hawaii's full jurisdiction over intrastate motor carriers of passengers and property. Although Hawaii's law provides exemptions, your Committee believes that the law needs to be updated and modernized to recognize and accommodate for advancements in technology.
Your Committee has amended this measure by:
(1) Reinstating the Public Utilities Commission's authority to regulate ratemaking for motor carriers;
(2) Changing the effective date to July 1, 3000, to encourage further discussion; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1301, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1301, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
