Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1293, H.D. 2, S.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO DEPARTMENT OF EDUCATION PROCUREMENT,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Temporarily, until June 30, 2028:
(A) Exempt, from the requirement to conduct procurements through the State's electronic system, Department of Education purchases of local edible produce and packaged food products costing less $250,000;
(B) Require at least three written quotes for Department of Education purchases of local edible produce and packaged food products within a certain cost range; and
(C) Require at least two written quotes for Department of Education purchases for certain schools in rural communities of local edible products and packaged food products that are between a certain cost range; and
(2) Appropriate $20,000,000 to the Department of Education for fiscal year 2025-2026 to address the Food Services Program shortfall, as requested in Governor's Message No. 9.
Your Committee on Conference has amended this measure by:
(1) Clarifying that at least three written quotes is required for Department of Education purchases of local edible produce and packaged food products of less than $250,000;
(2) Deleting language that would require at least two written quotes for Department of Education purchases for certain schools in rural communities of local edible products and packaged food products that are between a certain cost range;
(3) Removing the appropriation;
(4) Changing the effective date to July 1, 2025; and
(5) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 1293, H.D. 2, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 1293, H.D. 2, S.D. 2, C.D. 1.
