Sir:

 

     Your Committee on Ways and Means, to which was referred H.B. No. 1167, H.D. 1, S.D. 1, entitled:

 

"A BILL FOR AN ACT MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF TRANSPORTATION,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to make an emergency appropriation to the Department of Transportation to pay for payroll, fringe benefits, and administration costs for the enforcement of the Motor Carrier Law.

 

     Your Committee received written comments in support of this measure from the Department of Transportation.

 

     Your Committee finds that Act 117, Session Laws of Hawaii 2024, transferred the enforcement of the Motor Carrier Law from the Public Utilities Commission to the Department of Transportation, but did not appropriate moneys to pay for positions and administrative costs.  Your Committee further finds that this measure makes the appropriations necessary for the Department of Transportation to administer the Motor Carrier Law.

 

     Your Committee respectfully requests that if a Committee on Conference is convened to deliberate on this measure, it consider the testimony of the Department of Transportation, which requested that this measure be amended by:

 

     (1)  Appropriating $600,000 out of the state highway fund for fiscal year 2024-2025, and depositing those funds into the photo red light imaging detector systems program special fund;

 

     (2)  Appropriating $600,000 out of the photo red light imaging detector systems program special fund for fiscal year 2024-2025 for establishing the photo red light imaging detector systems pilot program, and providing:

 

          (A)  For the lapse of those funds on June 30, 2027; and

 

          (B)  For the transfer of $250,602 of those funds to the Department of the Prosecuting Attorney of the City and County of Honolulu for personnel costs related to the photo red light imaging detector systems pilot program; and

 

     (3)  Extending the lapse date of certain moneys previously appropriated out of the photo red light imaging detector systems program special fund until June 30, 2027.

 

     As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1167, H.D. 1, S.D. 1, and recommends that it pass Third Reading.
