Your Committees on Judiciary and Ways and Means, to which was referred H.B. No. 1141, H.D. 1, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO UPDATING PUBLIC LAND LEASES ISSUED PURSUANT TO CHAPTER 171, HAWAII REVISED STATUTES,"
beg leave to report as follows:
The purpose and intent of this measure is to require that lease extensions approved by the Board of Land and Natural Resources be drafted on forms that reflect contemporary leasing practices and policies of the Board, and which shall control over conflicting or inconsistent provisions in the lease being extended.
Your Committees received testimony in support of this measure from the Department of Land and Natural Resources.
Your Committees received testimony in opposition to this measure from Komike O Kupuna Ainahoopulapula.
Your Committees received comments on this measure from one individual.
Your Committees find that the Board of Land and Natural Resources currently does not have the authority to update the terms and conditions of its leases in the lease extension process utilizing the most current lease form. Inconsistencies with the prior lease extension form has created a lengthy process to update and codify lease extension agreements. Empowering the Board of Land and Natural Resources to update the terms and conditions of leases using the most current lease form will eliminate inconsistency and conflict between the Board and tenants. Therefore, this measure ensures operational efficiency for the lease extension process to allow the Department of Land and Natural Resources to effectuate its statutory mandate.

Committees have amended this measure by making technical, nonsubstantive amendments for the purposes of
clarity and consistency.
As affirmed by the records of votes of the members of your Committees on Judiciary and Ways and Means that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 1141, H.D. 1, S.D. 1, as amended herein, and recommend that it pass Third Reading in the form attached hereto as H.B. No. 1141, H.D. 1, S.D. 2.
