Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 1141, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO UPDATING PUBLIC LAND LEASES ISSUED PURSUANT TO CHAPTER 171, HAWAII REVISED STATUTES,"

begs leave to report as follows:

The purpose of this measure is to require lease extensions approved by the Board of Land and Natural Resources to be drafted on the most current approved lease form, to be subject to the most current leasing practices and policies, not rules, of the Board of the Land and Natural Resources, and control over conflicting or inconsistent provisions in a lease being extended.

Your Committee received testimony in support of this measure from the Department of Land and Natural Resources.

Your Committee finds that updated lease terms and conditions will allow the State to secure a fair return for the use of public lands, while also reducing liability for outdated structures on those lands.

As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1141, H.D. 1, and recommends that it pass Third Reading.
