Madame:

 

     Your Committee on Health, to which was referred H.B. No. 1120 entitled:

 

"A BILL FOR AN ACT RELATING TO NUISANCES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to clarify the legal authority of the Department of Health to prevent and address nuisances that threaten public or environmental health, or both.

 

     Your Committee received testimony in support of this measure from the Department of Health and one individual.  Your Committee received testimony in opposition to this measure from five individuals.

 

     Your Committee finds that the scope of nuisances overseen by the Department of Health is overly broad, as it encompasses all health, which leads to ambiguity as to the Department's role in addressing nuisances.  It is therefore in the interest of public health and safety to clarify that the Department of Health's oversight is specifically for nuisances that threaten public health, environmental health, or both.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (2)  Making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Health that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1120, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1120, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
