Madame:
Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 1091 entitled:
"A BILL FOR AN ACT RELATING TO SEWER TRANSMISSION LINES,"
begs leave to report as follows:
The purpose of this measure is to require a county to accept, within 60 days after receipt of a completed application for maintenance request, license or dedication of all sewer transmission lines and other sewerage facilities servicing Hawaiian Home Lands that are brought into compliance by the Department of Hawaiian Home Lands.
Your Committee finds that the Department of Hawaiian Home Lands manages sewer transmission lines that are to be transferred to the various counties for long-term management and maintenance. Your Committee further finds that this measure will help to ensure that these sewer transmission lines are transferred to the counties in a timely manner. Your Committee also finds that the cost savings for the Department of Hawaiian Home Lands from not having to manage and maintain sewer transmission lines would allow for more lots to be developed for applicants on the Department's waiting list and other maintenance needs for lessees who reside on Hawaiian Home Lands.
Your Committee has amended this measure by:
(1) Clarifying that a county is required to accept, within 60 days after receipt of a completed application for maintenance request, license or dedication of all sewer transmission lines and related sewerage facilities servicing Hawaiian Home Lands that are brought into compliance by the Department of Hawaiian Home Lands; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1091, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1091, H.D. 1, and be placed on the calendar for Third Reading.
