Madame:

 

     Your Committee on Education, to which was referred H.B. No. 1088 entitled:

 

"A BILL FOR AN ACT RELATING TO SCHOOL IMPACT FEES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to exempt housing developed by the Department of Hawaiian Home Lands from school impact fees.

 

     Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands and School Facilities Authority.  Your Committee received comments on this measure from the Department of Education and Tax Foundation of Hawaii.

 

     Your Committee finds that the Department of Hawaiian Home Lands leases some of its lands for educational facilities at minimal to no cost.  Additionally, the Department of Hawaiian Home Lands does consider the need for educational facilities when developing its affordable housing plan.  Your Committee believes that exempting housing developed by the Department of Hawaiian Home Lands from school impact fees will allow for more homes to be developed and thus benefiting more native Hawaiian beneficiaries.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style

 

     As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1088, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1088, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
