Madame:

 

     Your Committee on Education, to which was referred H.B. No. 1074 entitled:

 

"A BILL FOR AN ACT RELATING TO THE USE OF PUBLIC LANDS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require the School Facilities Authority to consult with the Department of Education and other impacted departments or agencies prior to the conveyance of ownership rights or lease of lands owned or occupied by the Department of Education or other impacted departments or agencies to the School Facilities Authority.

 

     Your Committee received testimony in support of this measure from the Department of Education.  Your Committee received comments on this measure from the School Facilities Authority.

 

     Your Committee finds that requiring consultation with the Department of Education and other impacted departments or agencies by the School Facilities Authority (Authority) prior to any conveyance of ownership rights or lease of lands to the Authority will promote a practical, balanced, and cooperative approach to state land management and ensure that the Authority's land use decisions align with the Department of Education's operational and strategic goals.

 

     Your Committee has amended this measure by:

 

     (1)  Deleting the requirement that the Department of Education's transfer of land be based upon terms and conditions as may be agreed to by the parties;

 

     (2)  Changing the effective date to July 1, 3000; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1074, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1074, H.D. 1, and be referred to your Committee on Water & Land.
