Madame:

 

     Your Committee on Transportation, to which was referred H.B. No. 102 entitled:

 

"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"

 

begs leave to report as follows:

 

     The purpose of this measure is to prohibit the issuance of a certificate of inspection for a moped or motor vehicle that has been altered, installed, or otherwise modified in any way that will noticeably increase the noise emitted by the motor vehicle or moped above that emitted by the motor vehicle or moped as equipped from the factory.

 

     Your Committee received testimony in support of this measure from Citizens Against Noise and six individuals.  Your Committee received testimony in opposition to this measure from ten individuals.  Your Committee received comments on this measure from the Department of Transportation and Motorcycle Industry Council.

 

     Your Committee finds that excessive noise from modified vehicle and moped mufflers has become a growing nuisance, negatively affecting the quality of life in Hawaii's communities.  This measure addresses altered or modified mufflers that noticeably increase noise, thereby promoting quieter and safer roadways.

 

     Your Committee has amended this measure by:

 

     (1)  Establishing an exception for motorcycles and mopeds that do not exceed certain federal regulations;

 

     (2)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 102, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 102, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
