Madame:
Your Committee on Water & Land, to which was referred H.B. No. 1007 entitled:
"A BILL FOR AN ACT RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY,"
begs leave to report as follows:
The purpose of this measure is to streamline transit-oriented development infrastructure improvements by making Chapter 206E, Part X, Hawaii Revised Statutes, relating to transient-oriented development infrastructure improvements, a program under the Hawaii Community Development Authority, rather than districts to be overseen by a board.
Your Committee finds
that the transit-oriented development infrastructure improvement districts
established by Act 184, Session Laws of Hawaii 2022 (Act 184), could be more
efficiently administered and managed.
Your Committee further finds that Act 184 contemplated these districts
would be overseen by boards established within each county. However, to date these boards have not been
constituted. Your Committee believes
that repealing the transit-oriented infrastructure improvement districts and
boards and reconstituting them as a program under the Hawaii Community
Development Authority will allow for greater collaboration with private
entities and federal, state, and county agencies to complete community
development plans for the betterment of the State.
Your
Committee has amended this measure by:
(1) Changing the effective date to July 1, 3000,
to encourage further discussion; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
Your Committee respectfully requests your Committee on Judiciary & Hawaiian Affairs, should it deliberate on this measure, to request the Hawaii Community Development Authority to expand on the fiscal impact of the shift from assessments against real property owners to fees assessed against users in the improvement areas.
As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1007, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1007, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
