SENATE CONCURRENT
RESOLUTION
requesting the department of law enforcement to establish, in collaboration with the city and county of honolulu, fair policies and processes for towing and disposing of vehicles that belong to active duty servicemembers and that are abandoned on state or city property.
WHEREAS, some active duty servicemembers who deploy for extended periods leave their personal vehicles parked on streets, in parking lots, or on other State or city property; and
WHEREAS, the abandoned vehicles can create safety concerns and parking problems and may become a nuisance for other residents; and
WHEREAS, the towing and disposal processes for a servicemember's abandoned vehicle must comply with the federal Servicemember Civil Relief Act; and
WHEREAS, it is important for the State and county to balance the servicemember's rights with the rights of other residents who may be inconvenienced by the abandoned vehicle; now, therefore,
BE IT RESOLVED by the Senate of the Thirty-third Legislature of the State of Hawaii, Regular Session of 2025, the House of Representatives concurring, that the Department of Law Enforcement is requested to establish, in collaboration with the City and County of Honolulu, fair policies and processes for towing and disposing of vehicles that belong to active duty servicemembers and that are abandoned on State or city property; and
BE IT FURTHER RESOLVED that the policies and processes should provide adequate notice to a deployed servicemember if the member's vehicle has been towed and should otherwise comply with the federal Servicemember Civil Relief Act; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Law Enforcement, Mayor of the City and County of Honolulu, and Chair of the Honolulu City Council.
