A BILL FOR AN ACT

RELATING TO THE UNIFORM CONTROLLED SUBSTANCE ACT.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 329-14, Hawaii Revised Statutes, is amended as follows:

1. By amending subsection (b) to read:

"(b) [Any] Opiates. Unless specifically excepted or unless listed in another schedule, any of the following opiates, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, [unless specifically excepted,] whenever the existence of these isomers, esters, ethers, and salts is possible within the specific chemical designation:

3. By amending subsection (f) to read:

"(f) Stimulants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers:

(1) Amineptine (7-[(10,11-dihydro-5H-dibenzo[a,d]cycloheptene-5-yl)amino]ehptanoic acid);

[(2)] (3) Cathinone;

(A) By substitution in the ring system to any extent with alkyl, alkylenedioxy, alkoxy, haloalkyl, hydroxyl, or halide substituents, whether or not further substituted in the ring system by one or more other univalent substituents;

(B) By substitution at the 3-position with an acyclic alkyl substituent; or

(C) By substitution at the 2-amino nitrogen atom with alkyl, dialkyl, benzyl, or methoxybenzyl groups, or by inclusion of the 2-amino nitrogen atom in a cyclic structure.

[(10)] (14) 1-(4-methoxyphenyl)-N-methylpropan-2-amine (Other names: para-methoxymethamphetamine; PMMA)."

SECTION 2. Section 329-16, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

"(f) Immediate precursor. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation [which] that contains any quantity of the following substances:

(1) Immediate precursor to amphetamine and methamphetamine:

(A) Phenylacetone, phenyl-2-propanone (P2P), benzyl methyl ketone, methyl benzyl ketone;

(2) Immediate precursors to phencyclidine (PCP):

(A) 1-phenylcyclohexylamine; or

(B) 1-piperidinocyclohexanecarbonitrile (PCC); or

(3) Immediate precursor to [Fentanyl:] fentanyl:

(A) [4-anilino-N-phenethyl-4-piperidine] 4-anilino-N-phenethylpiperidine (ANPP); or

(B) N-phenyl-N-(piperidin-4-yl)propionamide (norfentanyl)."

SECTION 3. Section 329-20, Hawaii Revised Statutes, is amended to read as follows:

"§329-20 Schedule IV. (a) The controlled substances listed in this section are included in schedule IV.

(b) Depressants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances, including its salts, isomers, esters, ethers, and salts of isomers, whenever the existence of these isomers, esters, ethers, and salts is possible within the specific chemical designation, that has a degree of danger or probable danger associated with a depressant effect on the central nervous system:

(1) Alprazolam;

(2) Barbital;

(3) Brexanolone;

(4) Bromazepam;

(5) Butorphanol;

(6) Camazepam;

(7) Carisoprodol;

(8) Chloral betaine;

(9) Chloral hydrate;

[(c) Fenfluramine. Any material, compound, mixture, or preparation which contains any quantity of the following substances, including its salts, isomers, and salts of isomers, whenever the existence of such salts, isomers, and salts of isomers is possible: Fenfluramine.

(d)] (c) Stimulants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation [which] that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of such isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1) Cathine ((+)-norpseudoephedrine);

(2) Diethylpropion;

(3) Fencamfamin;

(4) Fenproporex;

(5) Lorcaserin;

(6) Mazindol;

(7) Mefenorex;

(8) Modafinil;

(9) Pemoline (including organometallic complexes and chelates thereof);

(10) Phentermine;

(11) Pipradrol;

(12) Serdexmethylphenidate;

(13) Sibutramine;

(14) Solriamfetol; and

(15) SPA (1-dimethylamino-1,2-diphenylethane, lefetamine).

[(e)] (d) Other substances. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation [which] that contains any quantity of the following substances, including its optical isomers and its salts, isomers, and salts of isomers:

(1) Pentazocine; and

(2) Eluxadoline (5-[[[(2S)-2-amino-3-[4-aminocarbonyl)-2,6-dimethylphenyl]-1-oxopropyl][(1S)-1-(4-phenyl-1H-imidazol-2-yl)ethyl]amino]methyl]-2-methoxybenzoic acid[.]).

[(f)] (e) The department of law enforcement may except by rule any compound, mixture, or preparation containing any depressant substance listed in subsection (b) or any stimulant listed in subsection [(d)] (c) from the application of all or any part of this chapter if the compound, mixture, or preparation contains one or more active medicinal ingredients not having a depressant or stimulant effect on the central nervous system, and if the admixtures are included therein in combinations, quantity, proportion, or concentration that vitiate the degree of danger or probable danger of the substances which have a depressant or stimulant effect on the central nervous system.

[(g)] (f) Narcotic drugs. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation containing any of the following narcotic drugs, or their salts calculated as the free anhydrous base or alkaloid, in limited quantities as set forth below:

(1) Not more than one milligram of difenoxin and not less than twenty-five micrograms of atropine sulfate per dosage unit;

(2) Dextropropoxyphene (alpha-(+)-4-dimethylamino-1, 2-diphenyl-3-methyl-2-propionoxybutane); and

(3) 2-[(dimethylamino)methyl]-1-(3-methoxyphenyl)cyclohexanol, its salts, optical and geometric isomers and salts of these isomers (including tramadol)."

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 3000.
