Your Committee on Water & Land, to which was referred H.B. No. 1035 entitled:
"A BILL FOR AN ACT RELATING TO HOMELAND SECURITY,"
begs leave to report as follows:
Your Committee
received testimony in support of this measure from the Department of Defense,
Hawai‘i Office of Homeland Security,
Hawaii State Energy Office, Hawaiian Electric, and one individual. Your Committee received comments on this
measure from the Office of Information Practices.
Your Committee finds that in order for the
State to fulfill its responsibilities regarding protection of critical
infrastructure, it is necessary to establish protections for critical
infrastructure information. The sharing
of critical infrastructure information between infrastructure owners and
operators and state government is essential in supporting the security and
resilience of the State. This measure
ensures that the critical infrastructure information that is received and
maintained by the Office of Homeland Security is on par with the protections
that are offered by the Department of Homeland Security, adding reassurance
that shared proprietary information will be protected.
Your Committee has amended this measure by:
(1) Clarifying the definition of "critical infrastructure information" to mean information not subject to public disclosure under the Uniform Information Practices Act and related to the security of critical infrastructure or protected systems;
(2) Changing the effective date to June 30, 3000, to encourage further discussion; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1035, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1035, H.D. 1, and be referred to your Committee on Finance.
