A BILL FOR AN ACT
RELATING TO INTOXICATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291E, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:
"§291E-
Facilitating
the intoxication of a vehicle operator. (a) No person shall intentionally encourage or
coerce any other person to consume alcohol or any other intoxicant for the
purpose of enabling the other person to operate a vehicle under the influence
of an intoxicant.
(b)
A person found guilty of violating this section shall be subject to the
same penalties imposed on a person convicted of operating a vehicle under the
influence of an intoxicant under section 291E-61."
SECTION
2. This Act does not affect rights and duties
that matured, penalties that were incurred, and proceedings that were begun
before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
