A BILL FOR AN ACT
RELATING TO AQUACULTURE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§141- Aquaculture advisory committee. (a)
There is established an aquaculture advisory committee within the
department for administrative purposes.
The advisory committee shall provide expert and credible guidance to
support and strengthen aquaculture throughout the State.
(b) The advisory committee shall consist of twelve
members who are experienced in aquaculture, including:
(1) Six
producing aquafarmers; provided that there shall be at least one aquafarmer from
each county;
(2) Two
researchers;
(3) One
representative from extension or investing;
(4) Two
representatives from the seafood distribution industry, including wholesalers,
distributors, and the restaurant sector; and
(5) One
representative from the Hawaii Farm Bureau.
The
members of the advisory committee shall be appointed by the governor as
provided in section 26-34, from a list of nominees submitted by the
chairperson. The terms of advisory
committee members shall be two years, unless extended on a case-by-case basis
by a majority vote of the advisory committee members.
(c) The advisory committee shall be subject to
chapter 92 and shall meet at least quarterly to review the status of the
State's aquaculture industry and shall make recommendations to the chairperson
on at least an annual basis. The
advisory committee may meet and subsequently make recommendations at additional
times as determined by a majority of the members.
(d)
The members of the advisory committee shall serve without compensation
but shall be reimbursed for expenses, including travel expenses, necessary for
the performance of their duties.
(e) The department shall provide administrative
support to the advisory committee."
SECTION 2. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $ or per cent. This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only. The reasons for exceeding the general fund expenditure ceiling are that:
(1) The appropriation made in this Act is necessary to serve the public interest; and
(2) The appropriation made in this Act meets the needs addressed by this Act.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $50,000 or so much thereof as may be necessary for fiscal year 2024-2025 for the establishment of the aquaculture advisory committee.
The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.
