A BILL FOR AN ACT
relating to aquaculture.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
(1) The adoption of two new classifications of conditional shellfish growing areas. The classifications shall:
(A) Include "conditionally approved" and "conditionally restricted" shellfish growing areas to allow for more flexible management when a growing area is subject to fluctuating water conditions that are known and predictable, based on continual monitoring and data;
(B) Require a management plan that identifies and quantifies adverse conditions that temporarily restrict harvest or relay;
(C) Be subject to oversight by the department of health; and
(D) Require the management programs used in conditional growing areas to be subject to review and revision every three years based on the most up-to-date data and current environmental conditions;
(2) A requirement that all shellfish growing areas complete a new, comprehensive sanitary survey every twelve years and be subject to re-classification at that time;
(3) Species-specific requirements for relaying and depuration based on the most up-to-date science; and
(4) Annual water quality testing of growing areas and pre-harvest screenings of shellfish during adverse conditions.
SECTION 2. This Act shall take effect upon its approval.
