A BILL FOR AN ACT

 

 

RELATING TO PUBLIC PARKING SPACES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part     .  PUBLIC PARKING SPACES

     §291-A  Definitions.  As used in this part:

     "Motor vehicle" means every vehicle that is self-propelled and every vehicle that is propelled by electric power but not operated upon rails.

     "Parking meter" means a device located in the vicinity of a parking space for the purpose of granting parking privileges to persons for a certain number of minutes or hours upon the payment of required parking fees by a method allowed by the device.  "Parking meter" includes multi-space parking meter devices located in the vicinity of the parking spaces regulated by the device.

     "Public paid parking space" means any space that is designated for use by the general public as a space to park one or more motor vehicles upon payment of required parking fees.

     §291-B  Parking fees; payment method.  Effective January 1, 2025, all state- or county-owned parking lots in the State containing public paid parking spaces shall accept payment of parking fees by credit card and debit card.  All state- or county-owned parking meters in the State that collect parking fees for any public paid parking space shall be maintained in working order to accept payment by credit card and debit card.  Nothing in this section shall be construed to prohibit a state- or county-owned parking lot with public paid parking spaces or parking meters from also accepting payment by cash.  The State and counties may choose to stop accepting cash at any parking lot they own at their discretion."

     SECTION 2.  The department of accounting and general services, city and county of Honolulu, county of Maui, county of Kauai, and county of Hawaii shall submit reports of their progress in implementing section 291-B, Hawaii Revised Statutes, to the legislature no later than twenty days prior to the convening of each regular session beginning with the regular session of 2024 and ending upon implementation of the section.

     SECTION 3.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 4.  This Act shall take effect on July 1, 2050.
