A BILL FOR AN ACT
RELATING TO SPECIAL FUNDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§37-
Special funds; use for
capital improvement projects authorized. (a) Notwithstanding any law to the contrary, an
agency may expend moneys from special funds under the agency's control for
capital improvement projects, even if the expenditure of moneys for capital
improvement projects is not expressly authorized by the special fund's enabling
statute; provided that:
(1) Any expenditure on a capital
improvement project shall be subject to legislative appropriation or
authorization; and
(2) Unless otherwise authorized by law,
the agency shall not expend moneys for capital improvement projects in a fiscal
year that exceeds twenty per cent of the special fund's ceiling, if applicable.
(b) As used in this section, "agency" has the same meaning as in section 37-62."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
