A BILL FOR AN ACT
relating to small boat harbors.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§200- Small
boat harbor advisory board. (a) There
is established a small boat harbor advisory board under the department for
administrative purposes to advise the division of boating and ocean recreation
on the repair and maintenance of small boat harbor facilities and related waterways
under the department's jurisdiction.
(b)
The small boat harbor advisory board shall consist of the following eight
members:
(1) The chairperson
of the board of land and natural resources, who shall service as chair; and
(2) One member each
appointed by the governor, president of the senate, speaker of the house of
representatives, and each mayor of the counties.
(c) The
advisory board shall consist of members who are small boat harbor fee users,
with representation from user groups relating to mooring, boat trailers, commercial
tour operators, and commercial or recreational permit holders with a small boat
harbor.
(d)
Members shall:
(1) Be appointed
without regard to section 26-34;
(2) Serve without
compensation; and
(3) Serve a term of
years.
Vacancies shall be filled for the remainder of
any unexpired term in the same manner as original appointments.
(e) The small
boat harbor advisory board shall meet at least quarterly. A quorum shall consist of a simple majority
of voting members. All meetings of the
advisory board shall be conducted subject to chapter 92.
(f)
The small boat harbor advisory board shall advise the department on:
(1) The priority assigned
to various capital improvement projects related to the repair and maintenance
of small boat harbor facilities and related waterways under the department's
jurisdiction; and
(2) Any
required user fees and appropriations or other funding, including amounts
required, for capital improvement projects related to the repair
and maintenance of small boat harbor facilities and related waterways under the
department's jurisdiction.
The
advisory board shall not advise the department on the operations of small boat
harbors.
(g)
The small boat advisory board shall:
(1) Establish
committees of the board as necessary; and
(2) Seek input from
and provide timely feedback to interested individuals, stakeholders, and
community groups as necessary."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the administration of the small boat harbor advisory board.
The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2023.
