A BILL FOR AN ACT
RELATING TO BURIAL SITES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Therefore, the purpose of this Act is to clarify the definition of "burial site" to address the problematic aspect of the current definition.
SECTION 2. Section 6E-2, Hawaii Revised Statutes, is amended by amending the definition of "burial site" to read as follows:
""Burial
site" means any specific marked or unmarked location where
prehistoric or historic human skeletal remains [and their associated burial
goods] of an individual or set of individuals are [interred,]
found, and [its immediate] the surrounding [archaeological]
cultural context, including associated burial goods that may be
present, deemed a unique class of historic property and not otherwise
included in section 6E-41."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
