A BILL FOR AN ACT
RELATING TO AQUATIC LIFE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 195D-9, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) Any person who violates any [of the
provisions] provision of this chapter [[]or[] the
provisions of] any rule adopted hereunder shall be guilty of a misdemeanor
and shall be punished as follows:
(1) For a first offense by a fine of not less than
$250 or by imprisonment of not more than one year, or both; and
(2) For a second or subsequent offense within five
years of a previous conviction by a fine of not less than $500 or by
imprisonment of not more than one year, or both[.];
provided that if the violation involved the taking of aquatic life protected by this chapter, and the form of the taking was the harassment of the aquatic life, the person shall be imprisoned for no fewer than forty-eight hours for the violation."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
