A BILL FOR AN ACT
RELATING TO MOPEDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§286- Sale of new combustion engine-powered
mopeds; fee. (a) Beginning
January 1, 2025, every retailer in the State shall pay the department a fee of
$ for the sale of
each combustion engine-powered moped.
(b) Retailers may add the amount
of the fee imposed by subsection (a) to the price of a combustion
engine-powered moped and pass the amount of the fee to a consumer as a
component of the final retail price; provided that the amount of the fee shall
be stated separately on all invoices, sales signs, delivery slips, bills, and
statements that advertise or indicate the price of a combustion engine-powered
moped.
(c) This section shall not apply
to any individual or retailer from reselling, renting, or offering for resale
or rent a combustion engine-powered moped that was initially purchased in a
consumer transaction prior to January 1, 2025.
(d) All fees collected pursuant to
subsection (a) shall be deposited into the electric bicycle and electric moped
rebate program special fund established pursuant to section 196-7.8."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
