A BILL FOR AN ACT
RELATING TO AIR POLLUTION control.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§342B- Solid waste electric generating facilities;
air pollutants; emission limits. (a)
An owner or operator of a solid waste electric generating facility shall
ensure that each incinerator operating as part of the facility has
implemented air pollution controls sufficient to limit the emissions of:
(1) Nitrogen oxides;
(2) Mercury;
(3) Dioxins; and
(4) Any other air pollutant specified by
the director by rule,
to not
more than forty-five parts per million for each air pollutant, measured on an
average daily basis; provided that the director may specify a lower level for
each air pollutant by rule.
(b) The requirements of this section shall be in addition to any other requirements imposed by this chapter, any rule adopted under this chapter, and any other law."
SECTION 2. Section 342B-1, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:
""Solid waste electric generating facility" means a facility that generates electric energy from solid waste or municipal solid waste."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.

Description:
Requires an owner or operator of a solid waste electric generating facility to ensure that each incinerator operating as part of the facility has implemented air pollution controls sufficient to limit the emissions of nitrogen oxides, mercury, dioxins, and other air pollutants specified by the Director of Health to not more than 45 parts per million for each air pollutant, measured on an average daily basis. Authorizes the Director of Health to specify lower emission limits by rule.
