A BILL FOR AN ACT
relating to the department of land and natural resources.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 184, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§184- Rental
watercrafts; weekends; prohibited. (a) No person shall operate a rental watercraft
in a state park on a Saturday, Sunday, or state holiday.
(b)
For purposes of this section, "rental watercraft" has the same
meaning as in section 200- ."
SECTION 2. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§200- Registration
required for rental watercraft; registration number; fees. (a) Beginning January 1, 2025, no
person shall provide or offer to provide a rental watercraft to the public, unless
the rental watercraft is registered and numbered with the department on an
annual basis in accordance with rules adopted by the department before the use
or operation of a rental watercraft on or in the waters of the State.
(b) Beginning January 1, 2025, every rental watercraft
provided or offered for rent to the public shall have a registration number
affixed to the rental watercraft.
(c) The department shall establish reasonable
fees for the initial registration and annual renewal registration in accordance
with rules adopted pursuant to chapter 91.
(d) For purposes of this section, "rental watercraft"
means a kayak or paddleboard that is rented or leased or offered for rent or
lease in the State for a period of one month or less."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
