Status

RELATING TO COMMERCIAL ACTIVITIES ON BEACHES.

Prohibits any commercial vendor from presetting commercial beach equipment on any public beach under the jurisdiction of the Department of Land and Natural Resources, unless the customer is physically present.  Requires commercial vendors to expeditiously remove commercial beach equipment after the customer has finished using it.  Allows the Department of Land and Natural Resources to grant exemptions through rules.  Establishes administrative fines for violations.  Pertains only to public beaches and does not include private lands such as accreted lands and only within certain counties.  Effective 6/30/3000.  (HD1)

RELATING TO MINORS.

Requires providers of no-cost emergency shelter and related services to maintain separation for unrelated adults and minor children and take steps to ensure pertinent youth obtain and receive services from the juvenile justice or child welfare systems.  Makes permanent the amendments to the definition of "provider" as it relates to entities eligible to provide no cost emergency shelter and related services to consenting minors.  Effective 12/31/2050.  (HD1)

RELATING TO MINORS.

Allows minors sixteen years of age or older and emancipated minors to petition for domestic abuse protective orders.  Effective 6/30/2023.  (HD1)

Status

RELATING TO CHILD VISITATION.

Allows the court to award reasonable visitation rights to a petitioning grandparent of a minor child when the child's parent is unable to exercise parental visitation due to death or incarceration and denial of reasonable grandparent visitation rights would cause significant harm to the child.  Requires the court to follow best interest of the child procedures, considerations, and standards when granting grandparent visitation rights.  Specifies that any person who violates the terms and conditions of a court order granting reasonable grandparent visitation rights are subject to sanctions.  Effective 6/30/2023.  (HD1)

Status

RELATING TO THE UNIFORM CHILD-CUSTODY JURISDICTION AND ENFORCEMENT ACT.

Allows state courts discretion to not enforce a child-custody determination of a foreign country if the child-custody law of the foreign country imposes capital punishment for apostasy, religious or political beliefs, or homosexuality, and a parent or child demonstrates risk of being subject to the law.  Defines "apostasy".  Takes effect 03/22/2075.  (SD1)

RELATING TO THE YOUTH COMMISSION.

RELATING TO THE STATE REHABILITATION COUNCIL.

Reduces the number of members on the State Rehabilitation Council from twenty-one to fifteen.  Authorizes the State Rehabilitation Council to establish a quorum and conduct business without regard to vacancies.

RELATING TO GAMBLING.

RELATING TO TRANSPORTATION.

Authorizes the department of transportation to delay or deny approval for port entry or departure in instances when the department has received notice from a federal agency or other agency that a vessel or its crew has engaged in activity that has violated any federal, state, or county law or rule pertaining to environmental protection or maritime transportation.  Authorizes the department of transportation to grant approvals for use of any commercial harbor facility by a vessel in coordination with a federal agency or other agency.  Effective 6/30/3000.  (HD1)

RELATING TO EMERGENCY VEHICLES.

Makes it discretionary for authorized emergency vehicles to use sirens when responding to an emergency or in other specified situations if the siren is not reasonably necessary under the circumstances.  (SD1)

RELATING TO COMMERCIAL VEHICLES.

Prohibits commercial vehicles weighing ten thousand pounds or more from driving in the left lane on all roadways with two lanes unless the commercial vehicle is able to maintain speed with existing traffic flow and is in the process of passing another vehicle.  Provides exceptions for commercial vehicles turning or exiting left, or preparing to turn or exit left.  Prohibits commercial vehicles weighing ten thousand pounds or more from driving in the left lane on all roadways with three or more lanes.  Exempts buses and van pools operated by the counties.  Takes effect 7/1/2050.  (SD1)

RELATING TO TRANSPORTATION.

Increases the minimum and maximum fines for violating provisions relating to the installation of noisy mufflers.  Authorizes police officers with probable cause to stop vehicles with noisy mufflers to inspect their mufflers.  Effective 7/1/2050.  (SD2)

RELATING TO VEHICLES.

Prohibits a person from causing a diesel or gas-powered vehicle to discharge clearly visible smoke, soot, or other exhaust emissions onto another person or motor vehicle.  Establishes a $500 fine for violators.  Effective 6/30/3000.  (HD1)

RELATING TO UNMANNED AIRCRAFT SYSTEMS.

Establishes the offense of trespass with an unmanned aircraft system as a misdemeanor.  Effective 6/30/3000.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
