RELATING TO CAMPAIGN CONTRIBUTIONS BY CANDIDATE COMMITTEES. Amends section 11-357, HRS, to prohibit elected officials as defined in section 11-342(d), HRS, from soliciting and accepting campaign contributions during any regular session or special session of the State Legislature, including any extension of any regular session or special session and any legislative recess day, holiday, or weekend.

RELATING TO COMMITTEE FUNDRAISERS. Amends section 11-342, Hawaii Revised Statutes, to increase transparency by requiring candidate committees and noncandidate committees to file fundraiser notices regardless of the price or suggested contribution for attending the function.

RELATING TO ORDERS OF THE CAMPAIGN SPENDING COMMISSION. Amends section 11-410, HRS, by: (1) amending subsection (b) to provide that a person waives the right to a contested case hearing if the person fails to request a contested case hearing within 20 days of receipt of the Commission's preliminary determination; and (2) amending subsection (d) to provide that a final order of the Commission may be filed in the First Circuit Court for confirmation as a civil judgment, enforceable and collectible as any other judgment issued by the circuit courts.

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW. Increases the amount of fine from $1,000 to $5,000 that may be assessed against a noncandidate committee making only independent expenditures that has received at least 1 contribution of more than $10,000, or spent more than $10,000 in an election period, for campaign spending law violations. Allows the Campaign Spending Commission to order the fine be up to 3 times the amount of the unlawful contribution or expenditure, and to order that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

RELATING TO ORGANIZATIONAL REPORTS. Amends sections 11-322 and 11-333, Hawaii Revised Statutes, to require the Campaign Spending Commission ("Commission") to publish on its website the names of candidate and persons who qualify as noncandidate committees who fail to file an organizational report or a corrected organizational report with the Commission.

RELATING TO CANDIDATE COMMITTEE EXPENDITURES. Amends section 11-381, Hawaii Revised Statutes, to disallow the use of campaign funds to purchase up to two tickets for an event or fundraiser held by another candidate or committee.

RELATING TO PARTIAL PUBLIC FINANCING OF ELECTIONS. Increases the amount of partial public financing available for all offices. Amends section 11-425, HRS, by increasing the maximum amount of public funds available for all offices by 50%. Increases the maximum amount of public funds available for a candidate for the Office of Hawaiian Affairs from $1,500 to 10% of the expenditure limit established in section 11-423(d), HRS, for each election. Amends section 11-429(a), HRS, by increasing the amounts of qualifying contributions for the Office of Hawaiian Affairs from more than $1,500 in the aggregate to more than $5,000 in the aggregate. Provides a downward adjustment of the amounts of qualifying contributions for the Office of Prosecuting Attorney for the City and County of Honolulu, County of Hawaii, and County of Kauai and for the Office of County Council for the County of Maui. Appropriates unspecified sums for each of the 2 fiscal years of the next biennium to pay for the increase in the partial public financing program. Appropriates $200,000 for each of the 2 fiscal years of the next biennium for the Commission to hire 2 additional staff members.

RELATING TO CONTRIBUTIONS BY STATE AND COUNTY CONTRACTORS AND GRANTEES OF THE STATE. Extends the ban on campaign contributions from state and county contractors to grantees of the State under Chapter 42F, Hawaii Revised Statutes, and to the owners, officers, employees and immediate family of the government contractor or state grantee.

RELATING TO PRELIMINARY DETERMINATION OF PROBABLE CAUSE. Provides for the service of the commission's preliminary determination of probable cause via first-class mail.

RELATING TO COMPLAINTS ALLEGING VIOLATIONS OF CAMPAIGN SPENDING LAWS. Allows the Campaign Spending Commission to treat a respondent's failure to explain or otherwise respond to a complaint alleging a violation of campaign spending laws as an admission that a violation has occurred.

RELATING TO LIMITING A CAMPAIGN'S ACCEPTANCE OF CASH CONTRIBUTIONS. Limits to $100 the total amount of cash a candidate, candidate committee, or noncandidate committee may accept from a single person during each election period.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
