RELATING TO DECEPTIVE TRADE PRACTICES. Establishes that charging shipping and delivery charges that exceed the actual cost charged to the seller to ship or deliver a commodity to a consumer in Hawaii constitutes an unfair and deceptive practice.

RELATING TO THE UNIFORM COMMERCIAL CODE. Implements amendments to the Uniform Commercial Code set forth by the Uniform Law Commission.

RELATING TO SERVICE ANIMALS. Requires that a disclaimer be provided by sellers or providers of emotional support animals or certificates, identifications, tags, vests, leashes, and harnesses for emotional support animals that the animal is not a service animal. Establishes penalties.

RELATING TO NONPROFIT ORGANIZATIONS. Clarifies the application of the general excise tax law with regard to gross income derived from unrelated trade or business activities of nonprofit organizations. Effective 1/1/2024. Sunsets 12/31/2028.

RELATING TO AGRICULTURE. Extends the offense of false labeling of Hawaii-grown coffee to include roasted coffee. Imposes $10,000 fine for each separate offense of false-labeling of Hawaii-grown roasted coffee. Makes an appropriation for 1.0 FTE enforcement position.

RELATING TO TAX CREDITS. Establishes a tax credit for certain owners of a condominium whose association is increasing maintenance fees to comply with a county ordinance requiring an automatic fire sprinkler system or alternative fire prevention and fire safety system.

RELATING TO THE PUBLIC UTILITIES COMMISSION SPECIAL FUND CARRYOVER BALANCE. Increases the balance that may be retained in the Public Utilities Commission Special Fund at the end of each fiscal year from $1,000,000 to $3,000,000.

RELATING TO PENALTIES FOR UNLICENSED CARE HOMES. Clarifies the penalty to be assessed on any person who intentionally operates a care facility without a certificate or license.

RELATING TO THE REPEAL OF SECTION 328-106, HAWAII REVISED STATUTES. Repeals unenforceable and ineffective provisions from chapter 328, Hawaii Revised Statutes.
