A BILL FOR AN ACT
relating to unfair and deceptive practices.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§481B-
Digital application
subscription plans; price increases. (a) No digital
application developer or digital application distribution platform shall increase
the price of a digital application subscription plan that is automatically
billed to the user's account without first obtaining the user's written
consent.
(b) For the purposes of this
section:
"Digital application" means any application software program or group of programs designed to be downloaded or accessed on an electronic device, including a computer, smartphone, tablet, watch, or any other similar device.
"Digital
application developer" means the creator of a digital application made
available for download by end users through a digital application distribution
platform or other digital distribution platform.
"Digital
application distribution platform" means a digital distribution platform
for applications and services provided to a user on an electronic device including
a computer, smartphone, tablet, watch, or other similar device.
"User" means a person in the State who downloads or accesses a digital application."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
