A BILL FOR AN ACT

 

 

RELATING TO AFFORDABLE HOUSING ON HAWAIIAN HOME LANDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The legislature finds that affordable housing credits have been utilized by the department of Hawaiian home lands to provide affordable housing opportunities for its beneficiaries at no cost to the State.  This program allowed for the purchase of additional land in a location that beneficiaries were interested in but where the department had no land in the area, and resulted in a reduction in the price of housing units offered by homebuilders on Hawaiians home lands.

     The purpose of this Act is to make permanent the affordable housing credit program for the department of Hawaiian home lands.

     SECTION 2.  Act 141, Session Laws of Hawaii 2009, as amended by section 3 of Act 102, Session Laws of Hawaii 2015, as amended by section 1 of Act 80, Session Laws of Hawaii 2019, is amended by amending section 3 to read as follows:

     "SECTION 3.  This Act shall take effect on July 1, 2009[; provided that on July 1, 2024, this Act shall be repealed and section 46-15.1, Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day before the approval of this Act]."

     SECTION 3.  Act 98, Session Laws of Hawaii 2012, as amended by section 4 of Act 102, Session Laws of Hawaii 2015, as amended by section 50 of Act 55, Session Laws of Hawaii 2016, as amended by section 2 of Act 80, Session Laws of Hawaii 2019, is amended by amending section 3 to read as follows:

     "SECTION 3.  This Act shall take effect upon its approval[, and shall be repealed on July 1, 2024; provided that section 46‑15.1, Hawaii Revised Statutes, shall be reenacted pursuant to section 3 of Act 141, Session Laws of Hawaii 2009, and section 23 of Act 96, Session Laws of Hawaii 2014]."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.

     SECTION 5.  This Act shall take effect upon its approval.

Hawaiian Home Lands; Affordable Housing Credits

 

Description:

Makes permanent Act 141, Session Laws of Hawaii 2009, which requires the counties to issue affordable housing credits to the Department of Hawaiian Home Lands upon the Departmentꞌs request.  Makes permanent Act 98, Session Laws of Hawaii 2012, which requires the counties to issue affordable housing credits for each residential unit developed by the Department of Hawaiian Home Lands.  (SD1)
