A BILL FOR AN ACT
RELATING TO PUBLIC-PRIVATE PARTNERSHIPS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§103- Public-private
partnership contracts; legislative approval. (a)
Every state public-private partnership contract with a total contract
value of $ or more
shall be subject to legislative approval in the form of the adoption of a
concurrent resolution affirming the purpose, project, and contract issuance
before executing the public-private partnership contract.
(b) For the purposes of this section, "public-private
partnership" means a project delivery method in which the state purchasing
agency enters into a single contract for any combination of design, build,
financing, maintenance, or operation in addition to design-build of an
infrastructure facility over a contractually-defined period."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
