Amends provisions that exempt a proposed housing project of the Hawaii housing finance and development corporation from statutes, ordinances, charter provisions to include a requirement that the proposed project does not impact wetlands or natural stormwater infrastructure.  Requires an environmental assessment for actions under the environmental impact statements law that propose any development that would impact wetlands or natural stormwater infrastructure.

Requires that a current GET license number for any rental income be filed with the complaint to the court for summary possession proceedings.  Requires the judiciary to submit an annual list of certain information regarding summary possession cases to the department of taxation.

Restricts civil asset forfeiture to cases involving the commission of a covered offense where the person exercising some degree of control over the property is charged with an offense related to the property.  Raises the State's standard for forfeiture to clear and convincing evidence.  Authorizes the use of certain forfeited property by local or state agencies for a limited time.  Directs forfeiture proceeds to certain involved state and local governments and to the general fund.  Amends the allowable expenses for moneys in the criminal forfeiture fund.  Amends the requirements for the attorney general to adopt rules and report on the Hawaii omnibus criminal forfeiture act.  Effective 6/29/2022.

Establishes a tax withholding requirement for all payments to loan-out companies for services performed in Hawaii for persons claiming the motion picture, digital media, and film production income tax credit.  Prohibits the defense of erroneous claim for refund or credit if the claim for refund was generated by a tax credit.  Sets the penalty for the erroneous claim for refund or credit generated by a tax credit at ten per cent.  Requires taxpayers claiming the motion picture, digital media, and film production income tax credit to submit a sworn statement and verification review to the Department of Business, Economic Development, and Tourism only if qualified production costs exceed $1,000,000.  Requires reports by the Department of Business, Economic Development, and Tourism to the Legislature on the motion picture, digital media, and film production income tax credit to identify the dollar amount claimed, name of company, and name of program claiming the credit.  Extends the period during which excess credits may be claimed to December 31, 2032.  Requires qualified taxpayers claiming the motion picture, digital media, and film production income tax credit to withhold a certain amount and remit that amount within thirty calendar days to the Department of Taxation to the credit of the general excise tax account of the loan-out company.  Amends the uses of the Tax Administration Special Fund.

Establishes the state film coordinator in the department of business, economic development, and tourism to review, approve, and issue permits to film in the State.  Appropriates funds.

RELATING TO SUBSTANCES APPLIED ON STATE PROPERTY.

Establishes a list of substances allowed for use as pesticides and fertilizers on state property.  Provides that the use of substances not specifically allowed as pesticides and fertilizers on state property is prohibited, unless certain exceptions, a waiver, or exemption apply.  Requires a state department or agency seeking a waiver to apply to the department of agriculture.  Effective July 1, 2023.

Allows the elections commission to refer a complaint to the attorney general or county prosecutor in addition to any administrative determination and without the requirement that the commission believes the respondent has recklessly, knowingly, or intentionally committed a violation.  Disqualifies a person convicted of violating elections criminal prosecution laws from holding elective public office for ten years rather than four.  Repeals language stipulating that elections criminal prosecution law does not apply to any persons who has paid or agrees to pay fines related to report filing violations and advertisement violations prior to the commencement of the proceedings.

Amends the child abuse and neglect reporting requirement to specify that a member of the clergy shall not be required to report information gained solely during a penitential communication, unless exigent circumstances exist that justify disclosure of the abuse or neglect.  Specifies that the general rule of privilege applicable to confidential communications made to a member of the clergy does not apply to communications relating to known or suspected child abuse or neglect when exigent circumstances exist that justify disclosure of the abuse or neglect.

Requires all letterheads, documents, state highway signs, symbols, and emblems of the State and other political subdivisions that include Hawaiian names or words to include consistent Hawaiian names, spelling, and punctuation, including the use of kahako and ‘okina.  Establishes references for consistent Hawaiian names and words, including consistent Hawaiian spelling and punctuation.  Requires the governor, lieutenant governor, state legislators, and heads of principal departments to prominently display a Hawaiian language translation of the name of their respective office or department at least once on the main page of their official website and in the letterhead of their stationery.  Clarifies that the full text of bills and other official documents are not required to be written in Hawaiian and that inconsistently spelled or punctuated Hawaiian words and names shall not invalidate the documents or render them unenforceable and no cause of action shall arise accordingly.

Requires and establishes deadlines for state facilities, except smaller facilities, to implement cost-effective energy efficiency measures.  Directs the Hawaii State Energy Office to collect utility bill and energy usage data for state-owned buildings and to make the data publicly available.  Establishes a goal for the State to achieve at least twenty-five percent reduction in the electricity consumption of state facilities.  Beginning 7/1/2023, requires, where feasible and cost-effective, the design of all new state building construction to maximize energy and water efficiency, maximize energy generation potential, and use building materials that reduce the carbon footprint of the project.
