RELATING TO TRAFFIC.

Permits a bicyclist to proceed through an intersection from a right turn only lane if they cannot safely merge into the thru traffic lane, provided they signal intention to merge left.  Permits a bicyclist to proceed in a right turn only lane when approaching an intersection, even if they do not intend to turn right, provided that they do not pass a stopped vehicle and that they exercise reasonable safety when passing a moving vehicle.

RELATING TO VEHICLES.

Makes the registered owner of a vehicle that is in violation of stop, stand, or park requirements liable for any penalty.

RELATING TO CONSTRUCTION MANAGEMENT.

Creates a three-year pilot program within the Department of Transportation that requires procurement of professional services from construction management consultants using the competitive sealed bidding and competitive sealed proposals methods of procurement.  Exempts emergency procurements.  Requires annual reports to the Legislature.

SB 3170

      Status & Testimony

RELATING TO FUEL TAXES.

Allows federal pandemic relief funds received by the State to be used to supplement payment into the county highway funds.  Permits the County of Hawaii to appropriate the county's share of fuel tax revenue for the maintenance of substandard private subdivision roads that are used by the public.  Sunsets 6/30/27.

MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF TRANSPORTATION.

Makes an emergency appropriation to authorize additional funds for the Department of Transportation Highways Division's special maintenance program.

RELATING TO BICYCLE COMMUTING.

Establishes a goal for the Department of Transportation to have an unspecified percentage of commuting trips be by bicycle or e‑bike by 2030.

RELATING TO TRANSPORTATION.

Establishes the Multimodal Transportation Branch of the Department of Transportation to increase funding, pursue grants, and work on projects focusing on safe, low user cost pedestrian and bicycle infrastructure.  Effective 1/1/2023.

RELATING TO THE DEPUTY DIRECTOR OF HIGHWAYS OF THE DEPARTMENT OF TRANSPORTATION.

Requires the Deputy Director of Highways of the Department of Transportation to be subject to the advice and consent of the Senate.

RELATING TO TRANSPORTATION.

Establishes the Transportation Improvement and Modernization Commission to help ensure the Department of Transportation achieves states goals and outcomes while improving reporting to provide better transparency for elected leaders and the public.

RELATING TO HIGHWAYS.

Appropriates funds for capital improvement projects in the Waianae district to address traffic mitigation.

RELATING TO WATER CARRIERS.

Establishes the maritime commission to oversee the regulation of water carriers in the State.  Transfers the oversight of water carriers by the public utilities commission to the maritime commission and makes associated conforming amendments.  Establishes the maritime commission special fund.  Makes an appropriation.  Effective 7/1/2022.

      Status & Testimony

RELATING TO WATER CARRIERS.

Creates a two-tier rate adjustment for water carriers based on automatic annual increases or a justified increase based on actual costs and performance.  Establishes a water carrier agricultural cargo shipping subsidy with an annual rate increase.  Appropriates funds.

RELATING TO TAXATION.

Clarifies that amounts received or accrued for stevedoring services and related services, wharfage, and demurrage are exempt under the general excise tax law.

MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF TRANSPORTATION.

Makes an emergency appropriation to the Department of Transportation for construction of a new perimeter fence at Kahului Airport in response to the overpopulation of axis deer in Maui county.
