      Status & Testimony

RELATING TO THE HAWAIIAN HOMES COMMISSION.

Requires that the Governor make nominations to fill vacancies on the Hawaiian Homes Commission in accordance with recommendations by representatives of Hawaiian homestead and beneficiary associations.  Requires that the Governor make nominations to fill vacancies within sixty days.  Requires that eligible candidates for nominations have a working knowledge of the Hawaiian Homes Commission Act of 1920.

RELATING TO INDEPENDENT LEGAL COUNSEL.

Allows the Department of Hawaiian Home Lands to retain independent counsel as needed whose legal fees are to be paid for by the State.

RELATING TO INDEPENDENT LEGAL COUNSEL.

Allows the Department of Hawaiian home lands to retain independent legal counsel as needed.  Authorizes the Department of Hawaiian home lands to use the services of the Attorney General as needed and when the interests of the State and the Department of Hawaiian Home Lands are aligned.  Provides that funds owed to independent legal counsel shall be paid by the State.

SB 2608

      Status & Testimony

RELATING TO GAMBLING.

Requires the Department of Hawaiian Home Lands to conduct a feasibility study of the potential revenue to be generated by limited gaming in the State and the potential public health and safety impacts of casino gambling.  Makes an appropriation.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Excludes from any waiting list maintained by the Department of Hawaiian Home Lands any lessee or successor who sells or transfers their lease on a tract of Hawaiian home lands.

RELATING TO TAX EXEMPTION.

Exempts any homestead development for the Department of Hawaiian Home Lands from general excise taxes.

RELATING TO INTERIM ADMINISTRATIVE RULES OF THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Allows the Department of Hawaiian Home Lands after beneficiary consultation and upon approval by the Hawaiian Homes Commission to issue interim rules that shall be exempt from the public notice, public hearing, and gubernatorial approval requirements of chapter 91, Hawaii Revised Statutes.  The interim rules shall be effective for not more than eighteen months.

SB 3105

      Status & Testimony

RELATING TO ADOPTION.

Allows an adopted individual to benefit both by relationship through a natural parent and through an adoptive parent in a disposition or other designation as provided for in accordance with the Hawaiian Homes Commission Act, 1920, as amended, or administrative rules.  Allows the adopted individual and individual’s natural family to continue having the same familial relationship.
