RELATING TO MANDATORY ETHICS TRAINING. Requires all new state employees to complete ethics training either live or online within 90 days of the start of employment and every 4 years thereafter. Requires existing employees who have not received ethics training within the immediately preceding 3 years to complete live or online ethics training within 12 months of the Act's effective date and at least once every 4 years thereafter. Specifies that certain state officers shall complete live ethics training.

RELATING TO CHAPTER 92, HAWAII REVISED STATUTES. Adds definitions for "board business" and "informal gatherings". Specifies that a board may prepare and circulate amongst members a statement on a position previously adopted for purposes of submission to the legislature when notice by the legislature is insufficient to interact in any other permitted manner. Outlines when board packets must be available to interested persons. Requires the application of the sunshine law to all adjudicatory functions concerning land use.

RELATING TO THE UNIFORM INFORMATION PRACTICES ACT. Clarifies the legislature's intent regarding internal deliberative and pre-decisional materials of government agencies. Specifies that certain deliberative and pre-decisional materials that are a direct part of a government agency's internal decision-making process are not subject to disclosure if the disclosure of such materials would impair the agency's ability to make sound and fair decisions, but only to the extent that the impairment outweighs public interest in disclosure.

RELATING TO THE SUNSHINE LAW. Requires all boards to livestream meetings and archive the recordings online. Requires a board to identify each item on its meeting agenda as an item for action or an item for discussion and allow for oral testimony after each agenda item. Amends time frame requirements for the posting of board meeting minutes and board packets. Requires board meeting minutes and board packets to be posted online.

RELATING TO INFORMAL MEETINGS. Exempts members of a county council from the limitation on the number of members that may attend an informational meeting or presentation on matters relating to official county council business for purposes of permitted interactions. Clarifies that such meetings shall be meetings that are open to the public.

RELATING TO BOARDS. Allows a board to conduct up to one retreat in private per calendar year; provided that the board does not vote on any matter, make decisions, or deliberate toward a decision on any matter currently pending before the board or likely to arise before the board.

RELATING TO INTERIM ADMINISTRATIVE RULES OF THE DEPARTMENT OF HAWAIIAN HOME LANDS. Allows the Department of Hawaiian Home Lands after beneficiary consultation and upon approval by the Hawaiian Homes Commission to issue interim rules that shall be exempt from the public notice, public hearing, and gubernatorial approval requirements of chapter 91, Hawaii Revised Statutes. The interim rules shall be effective for not more than eighteen months.

Proposed HD1: Informs the public of the true sources of dark money contributions by requiring section 50l(c)(4) organizations to disclose the name and address of donors who donate an aggregate of more than $lOO, with certain exceptions. RELATING TO ORDERS OF THE CAMPAIGN SPENDING COMMISSION. Amends section 11-410, HRS, by: amending subsection (b) to provide that a person waives the right to a contested case hearing if the person fails to request a contested case hearing within twenty days of receipt of the Campaign Spending Commission’s preliminary determination; and amending subsection (d) to provide that a final order of the Commission may be filed in the First Circuit Court for confirmation as a civil judgment, enforceable and collectible as any other judgment issued in the circuit courts.

RELATING TO REPORTS FILED WITH THE CAMPAIGN SPENDING COMMISSION. Housekeeping measure that provides that candidates are not required to file preliminary general reports if they are either unsuccessful or are elected to office in the primary election. Amends subsections (b) and (c) of section 11-339, HRS, to make them consistent with subsection (a) by aggregating contributions and expenditures in determining whether a committee need only file the final election period report.

Allows the elections commission to refer a complaint to the attorney general or county prosecutor in addition to any administrative determination and without the requirement that the commission believes the respondent has recklessly, knowingly, or intentionally committed a violation. Disqualifies a person convicted of violating elections criminal prosecution laws from holding elective public office for ten years rather than four. Repeals language stipulating that elections criminal prosecution law does not apply to any persons who has paid or agrees to pay fines related to report filing violations and advertisement violations prior to the commencement of the proceedings.

Establishes a working group within the department of accounting and general services to study and recommend to the legislature improvements to the management of the state procurement office and methods of procurement, particularly in the area of natural resource management. Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
