RELATING TO ADVANCING CIVIC ENGAGEMENT. Appropriates funds for one full-time equivalent (1.0 FTE) position in the public access room to provide educational outreach and engagement with all schools in the State. Takes effect 7/1/2050. (HD1)

RELATING TO WAGES. Increases the penalty for employers who fail to pay the wages of their employees in accordance with the State's wage and hour law and payment of wages and other compensation law, to a class C felony. Adds a minimum penalty of $500 per violation. Effective 7/1/2050. (HD1)

RELATING TO THE UNIVERSITY OF HAWAII. Requires the University of Hawaii to establish K-12 expanded teaching cohort programs in each county for students who are pursuing undergraduate degrees in education. Requires interim reports to the legislature prior to the regular sessions of 2023, 2024, and 2025, and a final report prior to the regular session of 2026. Repeals 12/31/2026. (HD1)

RELATING TO NATIVE HAWAIIAN BENEFICIARIES. Requires the department of Hawaiian home lands to digitize its applicant, beneficiary, and lessee records by creating an interactive digital database software program to be completed and available for use no later than 7/1/2023. RELATING TO ENERGY. Authorizes the Hawaii technology development corporation to temporarily re-establish the Hawaii office of naval research grant program to provide fifty per cent matching grants to Hawaii awardees of alternative energy research grants from the Department of Defense Office of Naval Research. Establishes the alternative energy research and development revolving fund. Appropriates funds into and out of the revolving fund. Effective 7/1/2050. (HD1)

RELATING TO CONFORMITY TO THE INTERNAL REVENUE CODE. Conforms Hawaii income and estate and generation-skipping transfer tax laws to the Internal Revenue Code of 1986, as amended as of December 31, 2021.

RELATING TO THE GENERAL EXCISE TAX. Authorizes the Director of Taxation to exempt a taxpayer whose annual general excise tax liability does not exceed $100 from monthly, quarterly, or semiannual general excise tax filing requirements; provided that the taxpayer files an annual return. Applies to taxable years beginning after 12/31/2022.

RELATING TO THE TAX CREDIT FOR RESEARCH ACTIVITIES. Adds a cap for the amount of tax credits for research activities that an eligible taxpayer and the taxpayer's related entities may receive per taxable year. Consolidates the survey and certification requirements for tax credits for research activities. Increases the annual aggregate cap on tax credits for research activities that the department of business, economic development, and tourism may certify. Requires certification of the tax credits for research activities on a first-come, first-served basis to be based on the date that a complete application is received, subject to certain conditions. Effective 10/18/2050. (HD1)

RELATING TO THE HAWAII FILM AND CREATIVE INDUSTRIES DEVELOPMENT SPECIAL FUND. Expands the funding sources and authorized uses of the Hawaii film and creative industries development special fund. Makes an appropriation out of the special fund. Effective 10/18/2050. (HD1)

RELATING TO NONPROFIT ORGANIZATIONS. Clarifies the application of the general excise tax law with regard to gross income derived from unrelated trade or business activities of nonprofit organizations. Effective 10/18/2050. (HD1)

RELATING TO GRANTS. Allows an organization to qualify for grants under chapter 42F, Hawaii Revised Statutes, if the organization is incorporated under the laws of the State or spends at least ninety per cent of its operating budget in the State and is registered with the department of commerce and consumer affairs and in possession of a valid certificate of vendor compliance issued by the State. RELATING TO ECONOMIC DEVELOPMENT. Repeals the definition of "industrial park" in chapter 206M, Hawaii Revised Statutes, regarding the Hawaii technology development corporation. Replaces all instances of "industrial park" with a newly defined term, "economic zone", in that chapter. (HD1)

RELATING TO GOVERNMENT OPERATIONS. Establishes the director of business, economic development, and tourism, or a designee of the director, as an ex-officio, voting member of the Hawaii tourism authority, stadium authority, and school facilities authority board. Repeals the exemption for the stadium development special fund from the departmental administrative expenses assessment. Transfers the stadium authority from the department of accounting and general services to the department of business, economic development, and tourism. Amends the composition of the stadium authority. Reduces the amount of general obligation bonds that may be issued for the stadium development district. On 7/1/2023, transfers the school facilities authority from the department of education to the department of business, economic development, and tourism. Effective 10/18/2050. (HD1)

RELATING TO AQUACULTURE. Establishes provisions relating to the department of agriculture's governing of the business of aquaculture. Grants exclusive property rights to persons who lawfully obtain the cultured progeny of wild plants and animals by brood stock acquisition. Authorizes the department of agriculture to regulate the transportation, purchase, possession, and sale of specific aquaculture products as may be necessary to protect indigenous species. Requires the department of agriculture to prepare programmatic environmental impact reports and acquire land for aquacultural purposes. Makes appropriations. Effective 7/30/2075. (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
