RELATING TO SAFE NEIGHBORHOODS. Allows a defendant who has been convicted of four misdemeanors in any business district or resort zoned area to be sentenced to a probationary term of geographic restriction not exceeding an unspecified number of years during which the defendant shall be prohibited from entering the district or area in which the acts occurred. Mandates imprisonment of thirty days for violation.

RELATING TO TAXATION. Exempts the net capital gain from the sale of a residential property by a taxpayer who is sixty-five years of age or older from the capital gains tax.

RELATING TO TAXES. Establishes a tax withholding requirement for all payments to loan-out companies for services performed in Hawaii for persons claiming the motion picture, digital media, and film production income tax credit. Prohibits the defense of erroneous claim for refund or credit if the claim for refund was generated by a tax credit. Sets the penalty for the erroneous claim for refund or credit generated by a tax credit at ten per cent. Requires taxpayers claiming the motion picture, digital media, and film production income tax credit to submit a sworn statement and verification review to the Department of Business, Economic Development, and Tourism only if qualified production costs exceed $1,000,000. Requires reports by the Department of Business, Economic Development, and Tourism to the Legislature on the motion picture, digital media, and film production income tax credit to identify the dollar amount claimed, name of company, and name of program claiming the credit. Extends the period during which excess credits may be claimed to December 31, 2032. Requires qualified taxpayers claiming the motion picture, digital media, and film production income tax credit to withhold a certain amount and remit that amount within thirty calendar days to the Department of Taxation to the credit of the general excise tax account of the loan-out company. Amends the uses of the Tax Administration Special Fund.

RELATING TO THE DEPARTMENT OF BUSINESS, ECONOMIC DEVELOPMENT, AND TOURISM. Establishes the state film coordinator in the department of business, economic development, and tourism to review, approve, and issue permits to film in the State. Appropriates funds.

RELATING TO ECONOMIC DEVELOPMENT. Requires the Department of Business, Economic Development, and Tourism to promote the acquisition of appropriate patents and copyrights for "Hawaii Made" products and to conduct a study and prepare a plan for the promotion and enforcement of either a "Hawaii Made" or "Made in Hawaii" program and evaluate which name to use.

RELATING TO THE HAWAII FILM AND CREATIVE INDUSTRIES DEVELOPMENT SPECIAL FUND. Expands funding sources and authorized uses of the Hawaii Film and Creative Industries Development Special Fund. Makes an appropriation out of the special fund.

RELATING TO EARNED INCOME TAX CREDIT. Extends the availability of the state earned income tax credit until tax year 2028.

RELATING TO HAWAII TECHNOLOGY DEVELOPMENT CORPORATION. Appropriates moneys to the Hawaii Technology Development Corporation for its manufacturing assistance programs.

RELATING TO FILM INFRASTRUCTURE TAX CREDIT. Creates a nonrefundable twenty percent film infrastructure tax credit. Requires that the film infrastructure project must spend at least $3,000,000 on buildings, facilities, or installations. Caps the credit at $10,000,000 per year.

RELATING TO THE ECONOMY. Establishes a public policy framework that addresses state goals in the areas of economic disaster mitigation, economic diversification, import substitution, and community development. Appropriates moneys to the Department of Business, Economic Development, and Tourism to implement specific projects that address those goals. Identifies additional projects authorized in the executive budget to be implemented by the Department of Business, Economic Development, and Tourism in furtherance of those goals. Requires DBEDT to submit annual reports to the Legislature summarizing project outcomes, including an assessment of each project's effectiveness in achieving those goals.

RELATING TO GENERAL EXCISE TAX EXEMPTIONS. Establishes a general excise tax exemption for the gross proceeds or income from the manufacture, production, packaging, and sale of diapers.

RELATING TO SMALL BUSINESS LOANS. Creates the Hawaii Start-up Business Loan Program to be administered by the Business Development and Support Division of the Department of Business, Economic Development, and Tourism, in coordination with the Hawaii Technology Development Corporation. Establishes the Hawaii Start-up Business Loan Program Special Fund. Makes an appropriation.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
