Holds telecommunication service providers and third-party spoofing providers accountable by making certain robocalls and spoofing unlawful.  Effective 7/1/2050.  (SD2)

RELATING TO THE BARBERING AND COSMETOLOGY LICENSING ACT.

Adds and updates definitions to satisfy current industry practice needs.  Aligns and remedies inconsistencies between chapters 438 and 439, Hawaii Revised Statutes.  Removes the five-year license requirement for barber and beauty operator Board of Barbering and Cosmetology member seats.  Raises fees for penalties and disciplinary actions and removes medical clearance requirements.  (SD1)

RELATING TO HEALTH.

Requires all principals, guidance counselors, and teachers to perform self-review of seizure safety materials annually.  Requires a seizure action plan for every diagnosed student and distribution of the plan to employees charged with supervising the student.  Requires public schools, private schools, and public charter schools to have an employee trained to administer seizure disorder rescue medication.  Exempts schools that do not have a student with a seizure disorder.  Appropriates funds.  Effective 7/1/2050.  (SD1)

RELATING TO LIQUOR LICENSES.

Increases the maximum allowable fine for violation of liquor control laws by a licensee from $2,000 to $5,000.

RELATING TO FRANCHISE TAX.

Clarifies that the Compliance Resolution Fund is to receive $2,000,000 of the revenues collected under chapter 241, Hawaii Revised Statutes; provided that, if the revenues collected are under $2,000,000, the difference shall be received from revenues collected under chapter 235, Hawaii Revised Statutes, in an amount not to exceed $2,000,000.  Excess revenues collected under chapter 241, Hawaii Revised Statutes, shall be deposited into the general fund.  Effective 7/1/2050.  (SD2)

RELATING TO UNLAWFUL CHOP SHOP ACTIVITY.

Establishes the criminal offense of unlawful chop shop activity.  Provides for the forfeiture of property connected with chop shop activity.  Defines "chop shop."  Takes effect July 30, 2075.  (SD1)

Status

RELATING TO CATALYTIC CONVERTERS.

Requires used motor vehicle parts dealers to obtain a written statement that the seller has the lawful right to sell and dispose of the catalytic converter.  Requires certain sellers to provide copies of receipts or a notarized declaration that contains specific information regarding the purchase or acquisition of the catalytic converter.  Requires dealers to keep records of purchases and sales of catalytic converters, report purchases to the police department database, and tag and hold the catalytic converter for sixty days before selling or otherwise disposing of the catalytic converter.  Requires dealers to pay for catalytic converters by check.  Establishes the offense of theft of catalytic converter and makes it a class C felony.  Requires scrap dealers to keep records of purchases and sales of palladium, platinum, and rhodium.  Requires scrap dealers to pay for palladium, platinum, and rhodium by check.  Establishes that a person who violates certain scrap dealer requirements shall be guilty of a class C felony.  Requires each county police department to establish a database to collect and maintain information reported by used motor vehicle parts licensees regarding purchased catalytic converters and to initiate education programs to encourage residents to take personal measures to prevent catalytic converter thefts.  (SD2)

RELATING TO LEAF BLOWERS.

Clarifies that the residential zone restriction on the use of leaf blowers at certain hours includes residential districts, apartment districts, and business mixed use districts.  Removes the exemption on leaf blower restrictions for government agencies except in cases of emergency.  Effective 1/1/2050.  (SD2)

RELATING TO ADVANCE WARNING FOR EXCAVATION.

Applies the existing advance warning requirements to excavators operating on residential properties and clarifies various excavation requirements and reporting procedures.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
