RELATING TO INSURANCE. Amends various portions of title 24 of the Hawaii Revised Statutes to update and improve existing provisions.

RELATING TO CREDIT FOR REINSURANCE. Amends various sections of article 4A of chapter 431, Hawaii Revised Statutes, to maintain accreditation with the National Association of Insurance Commissioners.

RELATING TO MORTGAGE RESCUE FRAUD. Amends the definitions of a "distressed property consultant" and "mortgage assistance relief service" in section 480E-2, Hawaii Revised Statutes.

RELATING TO MORTGAGE SERVICERS. Authorizes the Commissioner of Financial Institutions (Commissioner) to modify or waive requirements in chapter 454M, Hawaii Revised Statutes, to implement changes and improvements made to the NMLS.

RELATING TO CONTROLLED SUBSTANCES. Bans hemp products that contain cannabinoids created through isomerization, including Delta 8 tetrahydrocannabinol. Adds Delta 8 tetrahydrocannabinol to the list of schedule I controlled substances. Effective 1/1/2222. (HD1)

RELATING TO RAW MILK. Authorizes and decriminalizes the direct sale of raw milk and raw milk products to consumers for human consumption, with certain restrictions. Authorizes the sale of raw goat milk for pet consumption. Requires the BOA and DOH to adopt rules by 7/1/2023. Establishes labeling requirements. (HD1)

RELATING TO THE YOUTH VAPING EPIDEMIC. Requires DOH to post online monthly updates on all deposits and expenditures of the tobacco enforcement and Hawaii tobacco settlement special funds and Hawaii tobacco prevention and control trust fund. Requires DOH to submit annual reports to the legislature on the receipts and expenditures of the Hawaii tobacco settlement special fund and Hawaii tobacco prevention and control trust fund. Requires the attorney general to monitor online sales of tobacco products and electronic smoking device products and post online monthly updates. Requires DOH to establish a standardized and scientific testing process for the presence of flavoring in tobacco products and synthetic nicotine products and post this information online. Beginning 1/1/2023, prohibits the sale or distribution of all flavored tobacco and synthetic nicotine products in the State. Requires DOH to coordinate with DOE to establish a take back program for students to voluntarily dispose of electronic smoking devices, flavored tobacco or synthetic nicotine products, and tobacco products in their possession. Requires DOH and DOE to coordinate quarterly meetings with students on addressing the youth vaping epidemic. Effective 7/1/2060. (HD1)

RELATING TO UNDERGROUND STORAGE TANKS. Prohibits the operation of underground storage tanks with a capacity greater than 100,000 gallons. (HD1)

RELATING TO UNDERGROUND FUEL STORAGE TANKS. Prohibits the issuance of future large capacity underground fuel storage tanks mauka of the applicable underground injection control line. Prohibits the operation of and renewal of permits for large capacity underground fuel storage tank permits located mauka of the applicable underground injection control line beginning 1/1/2045. Effective 7/1/2060. (HD1)

RELATING TO CORAL. Prohibits the sale, import, or export of coral products, with certain exceptions. Requires the Department of Land and Natural Resources to amend its administrative rules accordingly no later than 12/31/2022. Effective 7/1/2050. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
